skilly respects your privacy and is committed to protecting personal information responsibly.
This Privacy Policy explains how SKILLBUILDER IO INC, doing business as skilly, collects, uses, discloses, stores, and otherwise processes personal information when people:
- Visit the skilly website;
- Communicate with skilly;
- Create or manage customer accounts;
- Use skilly products, dashboards, and related services;
- Interact with AI-powered guides, agents, networks, and related experiences powered by skilly; or
- Otherwise engage with skilly where this Privacy Policy is presented.
This Privacy Policy is intended to work alongside skilly’s End-User Terms and skilly’s Platform Terms for Customers / Third-Party Teams. If you are an organization deploying a Guide through skilly, you may also be subject to separate commercial terms, a data processing addendum, order forms, or other agreements.
This Privacy Policy does not apply to:
- information processed solely on behalf of a customer where skilly acts only as a processor or service provider and the customer’s own privacy policy governs the relationship with the end user;
- third-party websites, services, platforms, applications, or integrations that are not controlled by skilly; or
- data practices of customers or other third parties once information has been exported, copied, stored, or otherwise retained outside the skilly platform.
If you do not agree with this Privacy Policy, do not use the applicable skilly services.
2. Who This Privacy Policy Applies To
This Privacy Policy may apply differently depending on your relationship with skilly.
a. Website visitors
If you visit skilly’s public-facing website, this Privacy Policy applies to information collected through that website and related communications.
b. Customer representatives
If you are a representative, employee, contractor, or user of a customer or prospective customer of skilly, this Privacy Policy applies to information related to your account, business relationship, support interactions, onboarding, and use of the platform.
c. End users of Guides
If you interact with a Guide powered by skilly, this Privacy Policy may apply to the extent skilly determines the purposes and means of processing certain information, such as platform-level account tools, privacy controls, security measures, and service operations. In other situations, the customer operating the Guide may be the party primarily responsible for the relevant processing.
d. Other individuals
This Privacy Policy may also apply to people who contact skilly, subscribe to updates, attend events, respond to marketing, or otherwise interact with skilly.
3. Important Role Distinctions
skilly provides infrastructure. Customers provide experiences.
Depending on the context, skilly may act as:
- a controller or business with respect to website operations, account administration, security, billing, direct relationships with customers, and certain platform-level operations;
- a processor or service provider acting on behalf of a customer that operates a Guide; or
- an independent party with limited platform responsibilities while the customer independently determines how to use exported data outside the platform.
Customers that deploy Guides are the Third-Party Teams referenced in skilly’s End-User Terms. Those customers may separately determine what services they offer, what information they request, whether they follow up with end users, and what their own privacy notices say. If a customer exports, copies, or stores data outside the skilly platform, that outside copy is governed by the customer’s own practices, not skilly’s platform controls.
4. Information skilly Collects
skilly may collect the following categories of information.
a. Contact and account information
This may include:
- name
- email address
- phone number
- organization name
- title or role
- login credentials or authentication identifiers
- account preferences and settings
b. Customer relationship and business information
This may include:
- contract, billing, payment, and subscription records
- onboarding details
- account notes
- implementation details
- support history
- communications with skilly
- product interest and sales records
c. Platform and usage information
This may include:
- login activity
- device and browser information
- IP address
- approximate location derived from IP
- usage logs
- performance data
- system diagnostics
- audit and security events
- metadata about features used, pages viewed, or workflows completed
d. Conversation and Guide interaction data
When people interact with Guides powered by skilly, skilly may process:
- prompts
- messages
- responses
- attachments
- transcripts
- timestamps
- routing information
- metadata about conversation flow
- user settings such as incognito, de-linking, or messaging preferences
- related administrative and security records
e. Information submitted by customers or end users
This may include information submitted through:
- forms
- imports
- integrations
- uploads
- APIs
- Guide configuration tools
- knowledge sources
- transcripts
- support requests
- other platform features
f. Marketing and communications data
This may include:
- subscription preferences
- event participation
- email engagement data
- responses to outreach
- information provided in surveys, forms, or inquiries
g. Information from third parties
skilly may receive information from:
- service providers
- integration partners
- analytics providers
- identity and authentication providers
- advertising or marketing tools
- customers
- publicly available sources
- referral partners
5. How skilly Collects Information
skilly may collect information:
- directly from you when you provide it;
- automatically through your use of the website, platform, or Guides;
- from customers who configure or operate Guides;
- from integrations and connected systems;
- from service providers and business partners; and
- from publicly available or lawfully obtained third-party sources.
6. Registered, Unregistered, and Incognito Experiences
Some skilly-powered experiences may be available without requiring an end user to create an account.
a. Unregistered user
If a person interacts with a Guide without registering, skilly may maintain the session using a temporary identifier, such as a session cookie or similar technology, to enable continuity and product functionality. In those cases, skilly may not associate the conversation with a persistent personal profile unless and until the user later identifies themselves or the experience is designed to collect identifiable information.
b. Registered user
If a person registers, signs in, or otherwise associates a Guide interaction with an account, skilly may link eligible conversation history, account settings, and privacy tools to that account.
c. Incognito mode
Where available, incognito mode allows eligible conversations to be de-linked from a user’s identifiable account within the skilly platform in the manner described in skilly’s End-User Terms. When incognito mode is active for an eligible Guide or network, skilly will not associate that conversation with the user’s account in a way that allows the operating customer to identify the user through skilly.
d. De-link all chats
Where available, a user may use the “De-link all chats” feature to remove the link between identity and prior eligible conversations within the skilly platform for a particular Guide or network, as described in the End-User Terms. This does not necessarily delete conversation content, and it does not affect copies retained outside the skilly platform.
e. Limits of these controls
These controls operate within the skilly platform. If a customer has already copied, exported, stored, or otherwise retained information outside of skilly, skilly cannot control that outside copy.
7. How skilly Uses Information
skilly may use personal information for the following purposes, as applicable:
- to operate, maintain, secure, and improve the website, platform, and related services;
- to create and manage accounts;
- to authenticate users and manage access;
- to provide customer support, onboarding, and implementation assistance;
- to process subscriptions, billing, and payments;
- to respond to inquiries, requests, and feedback;
- to operate Guides and support conversation continuity;
- to provide privacy controls such as registration status handling, incognito mode, de-linking, and messaging preferences;
- to enable customers to operate Guides and respond to end-user requests, subject to applicable settings and agreements;
- to monitor performance, troubleshoot issues, prevent abuse, and protect platform integrity;
- to conduct analytics, reporting, forecasting, and product development;
- to enforce terms, agreements, and policies;
- to comply with legal obligations and lawful requests;
- to send service-related notices, security alerts, administrative messages, and product communications;
- to send marketing communications where permitted by law and subject to your choices;
- to evaluate and improve safety, moderation, reliability, and user experience; and
- for any other purpose disclosed at the time information is collected or with your consent.
8. How skilly Uses AI and Automated Systems
skilly may use artificial intelligence, machine learning, retrieval systems, automation, rules-based systems, and human review in connection with its products and operations.
This may include use of such systems to:
- generate responses;
- route inquiries;
- classify or summarize information;
- support analytics and quality review;
- detect abuse, fraud, or security threats;
- improve platform operations and user experience; and
- support customers in configuring or operating Guides.
skilly does not state in this Privacy Policy that all customer or end-user data is used to train public or third-party foundation models. Any use of data for model improvement, tuning, evaluation, or related internal service improvement will be governed by applicable agreements, product settings, internal policies, and applicable law.
9. How skilly Discloses Information
skilly may disclose personal information in the following circumstances.
a. To service providers and infrastructure partners
skilly may disclose information to vendors, contractors, hosting providers, analytics providers, payment processors, support tools, communications platforms, authentication providers, and similar service providers that help operate the business and platform.
b. To customers operating Guides
Where a customer operates a Guide, skilly may make available to that customer the information the customer is permitted to access through the platform, subject to product design, applicable settings, and the user’s selections, including settings such as incognito mode and messaging preferences.
c. To integrations and connected systems
If a customer enables integrations, information may be transmitted to connected systems such as CRMs, APIs, databases, customer support tools, scheduling tools, or other platforms, subject to the customer’s configuration and responsibilities.
d. Within skilly’s corporate group
skilly may disclose information to affiliates, subsidiaries, and related entities for lawful business, operational, security, and administrative purposes.
e. In connection with corporate transactions
skilly may disclose or transfer information as part of a merger, acquisition, investment, financing, restructuring, sale of assets, bankruptcy, or similar corporate transaction.
f. For legal, security, and safety reasons
skilly may disclose information when reasonably necessary to:
- comply with law, regulation, subpoena, court order, or other lawful process;
- enforce agreements, terms, or policies;
- investigate fraud, abuse, or security incidents;
- protect the rights, property, safety, or security of skilly, customers, end users, or others; or

g. With consent or at your direction
skilly may disclose information where you direct it to do so or where you otherwise consent.
10. Customer-Controlled and Third-Party Data Practices
Customers operating Guides may collect, receive, export, combine, or store end-user information outside the skilly platform. If they do, they are independently responsible for that data and for compliance with applicable law.
This means:
- skilly’s platform controls do not govern copies retained outside of skilly;
- customers may have their own privacy notices, legal bases, retention periods, and rights-handling processes; and
- end users may need to contact the relevant customer directly for issues involving data the customer controls outside the platform.
Customers are prohibited by their platform terms from attempting to override privacy controls, re-identify incognito users, or ignore messaging preferences within the skilly platform.
11. Cookies and Similar Technologies
skilly may use cookies, pixels, session identifiers, SDKs, logs, and similar technologies to:
- operate the website and platform;
- maintain sessions;
- remember preferences;
- support security and authentication;
- understand usage and performance;
- improve user experience; and
- support communications, analytics, and lawful marketing.
Some cookies or similar technologies may be necessary for the operation of the website or platform. Others may support analytics, personalization, or communications.
You may be able to manage certain cookie settings through your browser or device controls. Blocking some technologies may affect functionality.
Where required by law, skilly will seek appropriate consent before using non-essential cookies or similar technologies.

skilly may process personal information in the United States and other countries where skilly, its affiliates, service providers, customers, or partners operate.
Data protection laws in those jurisdictions may differ from the laws in your place of residence. Where required by law, skilly will use reasonable contractual, technical, and organizational safeguards for cross-border transfers of personal data under its control.

skilly retains personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:
- provide services;
- maintain accounts and records;
- support customer relationships;

Retention periods vary depending on the nature of the information, the context of collection, product design, the role of the relevant customer, legal requirements, and operational needs.
Using incognito mode or de-linking does not necessarily delete conversation content. Those features affect how identity is linked within the skilly platform, not necessarily whether underlying records continue to exist.
15. Data Security
skilly uses reasonable administrative, technical, and organizational safeguards designed to protect personal information under its control against unauthorized access, misuse, loss, disclosure, or alteration.
No system is perfectly secure, and skilly cannot guarantee absolute security. You are also responsible for using strong credentials, safeguarding account access, and using the services responsibly.
If skilly becomes aware of a confirmed security incident affecting personal data under its control, skilly may investigate, contain, remediate, and provide notice as appropriate under applicable law, contractual obligations, and the circumstances of the incident.
16. Your Choices
Depending on the service and your relationship to skilly, you may be able to:
- update account information;
- manage communication preferences;
- use incognito mode for eligible Guides or networks;
- de-link prior eligible chats;
- request account deletion where available;
- manage cookie settings through browser controls; and
- unsubscribe from marketing communications.
Service-related notices, transactional messages, and certain administrative communications may still be sent where necessary.
17. Privacy Rights Requests
Subject to applicable law, you may have rights to request:
- access to personal information;
- correction of inaccurate information;
- deletion of certain information;
- portability of certain information;
- restriction of certain processing;
- objection to certain processing; and
- withdrawal of consent where processing is based on consent.
skilly may need to verify identity before acting on a request. skilly may deny or limit requests where permitted by law.
If the relevant information is controlled by a customer operating a Guide rather than by skilly, skilly may direct the request to that customer or instruct the requester to contact the customer directly.
18. Children and Minors
skilly’s public website and general platform are not directed to children under 13, and skilly does not knowingly collect personal information directly from children under 13 through its public website without appropriate authorization.
Where a customer deploys a Guide in a context involving minors, schools, families, youth programs, or similar settings, that customer is responsible for ensuring that the deployment, notices, authorizations, and data practices comply with applicable law.

19. California and Other U.S. State Privacy Disclosures
Depending on your state of residence, you may have rights under applicable state privacy law. skilly may process categories of personal information described in this Privacy Policy for the purposes described above and may disclose those categories to service providers, contractors, customers, affiliates, and other parties as described above.
skilly does not sell personal information in exchange for money in the ordinary meaning of that phrase. However, some laws define “sale,” “sharing,” or “targeted advertising” broadly. To the extent such laws apply, skilly will honor applicable rights and request mechanisms required by law.
California residents may also request certain information under California Civil Code Section 1798.83 by contacting skilly.
20. Region-Specific and Non-Waivable Rights
Nothing in this Privacy Policy limits any non-waivable rights you may have under applicable consumer, privacy, or data protection law.
21. Changes to This Privacy Policy
skilly may update this Privacy Policy from time to time. When required by law, skilly will provide notice of material changes in a commercially reasonable manner, such as by posting an updated version, updating the “Last modified” date, or providing notice through the website, platform, or email.
